Prema Care PTY LTD is committed to protecting the privacy and personal information of our clients, prospective employees, and all visitors to our website. This Privacy Policy outlines how we collect, use, disclose, and safeguard your information in compliance with the Australian Privacy Principles under the Privacy Act 1988 (Cth).
PRIVACY POLICY
Purpose of this Policy
1.1 The purpose of this Privacy Policy is to inform you what types of information Prema Care PTY LTD may gather about you when you visit our Site, or register to become a [Member, and to explain how we meet our obligations under the Privacy Act 1988 (Cth) (including the Australian Privacy Principles).
1.2 This Privacy Policy also explains:
how Prema Care collects and holds Personal Information
the purposes for which we collect and hold Personal Information
how we may use that Personal Information, and to whom we may disclose it
our disclosures of Personal Information to entities overseas
how you can access your Personal Information and request corrections
how you may inquire or make a complaint about our collection, handling, use, or disclosure of your Personal Information
how that inquiry or complaint will be managed
1.3 “Personal Information” generally refers to any information or opinion about an individual who is identified or can reasonably be identified. “Sensitive information” is a subset of Personal Information and may include details regarding a person’s physical or mental health (including any injuries or disabilities), as well as other information such as racial or ethnic background, religious beliefs, trade/professional association memberships, sexual orientation, or criminal record. In this Policy, references to “Personal Information” also include “sensitive information.”
1.4 Safeguarding your privacy is extremely important to Prema Care. We are dedicated to maintaining the security of any Personal Information provided to us through our [Site/Platform], including cases where you register yourself (or another person) to become a Member.
Definitions
2.1 In this Privacy Policy:
“[Affiliates]” means Prema Care’s Related Bodies Corporate, joint ventures, or other companies under common control.
“[Care Services]” refers to any home care, aged care, disability support, healthcare, or other care services arranged through our Platform, including associated travel or ancillary services.
“[Corporations Act]” means the Corporations Act 2001 (Cth), as amended from time to time.
“[Policy]” refers to this Privacy Policy as updated from time to time.
“[Privacy Act]” means the Privacy Act 1988 (Cth), as amended from time to time.
“[Related Bodies Corporate]” has the meaning described in the Corporations Act.
“[Site]” means www.premacare.com.au or relevant domain/sub pages.
2.2 Unless indicated otherwise, capitalized terms not defined in paragraph 2.1 or elsewhere in this Policy have the meanings provided in our relevant Terms of Use.
Who does Prema Care collect Personal Information from?
3.1 We may collect Personal Information from:
Visitors, when they visit our Site
User consent
By submitting Personal Information through our Site or Platform (including when you register yourself or another individual as a Member), you agree to the terms of this Policy on your own behalf or on behalf of the individual whose information you are submitting. You also expressly consent to the collection, use, and disclosure of that Personal Information as described in this Policy.
Types of data we collect
5.1 The nature of the information Prema Care collects about you depends on how and why you access our Site and use our Platform.
5.2 We collect both Personal Information and anonymous data, as detailed below.
(a) Information you provide to us
If you are a Support Worker, when you create an Account, we will collect Personal Information including (but not limited to) your first and last name, legal name, date of birth, driver’s license number or other identifying details (passport number, etc.), certifications for working with children/vulnerable individuals, background checks, criminal history, [ethnicity], [gender], [religion], cultural background, email and postal addresses, phone number, work experience, salary/income, professional license numbers, education, interests, hobbies, references (personal and professional), profile photos/videos, professional abilities, lifestyle information, schedule availability, music preferences, and bank details to facilitate direct deposit of earnings.
If you are a Client seeking Care Services for yourself, when you create an Account, we will collect information including (but not limited to) your first and last name, legal name, date of birth, driver’s license number or other identifying data, criminal history, [gender], cultural background, email and postal addresses, phone number, emergency contacts, details about required care services, care plan, health conditions, activities, profile photo, interests, music preferences, household details, and credit card data to facilitate payments.
If you are another type of Member (e.g., a family member, government-approved provider, or case manager/support coordinator), we will collect details similar to those noted in points (1) and (2) above.
(b) Sensitive Information
We may collect sensitive information (health details, genetic information, criminal history, ethnicity, religious views, etc.) from Clients and Support Workers when they opt to share details about themselves, or another person for whom they are authorized to act, regarding care needs.
(c) Other ways we may collect Personal Information
We may collect and maintain documents (files, messages, etc.) that you store in your Account.
If you contact us via email or online form, we will collect your name, email, and any additional content you include so we can respond or take action.
Posts or uploaded content on the Site or Platform may be stored on our servers and visible to Members you designate.
We may collect data on your operating system, version, or other technical details if you contact us about support.
You can opt not to provide certain information, but this may limit your access to some Site or Platform features.
(d) Information collected via technology
Our servers (which may be hosted by a third-party provider) automatically collect data such as browser type, operating system, IP address, domain name, and timestamps to enhance user experience and site performance.
Like many sites, we use cookies. Cookies help identify you when you return and store details about site usage. You can disable cookies via your browser settings, but certain features may be unavailable if you do so.
We may use (or enable) third-party analytics to track anonymous data.
Personal information may also be inferred via machine learning tools.
(e) Invitation emails
If you provide someone else’s email address for an invitation, you confirm you have their permission.
We store provided email addresses and associate them with your account.
We only send one invitation and do not use the email for other communications unless the individual joins Prema Care.
(f) Information collected from others about you
Some Members (Clients, case managers, etc.) may submit health data, care plans, or other sensitive details on your behalf.
Third parties may provide Personal Information about you where they are authorized to act on your behalf.
(g) Information collected from third parties
We may receive Personal Information/anonymous data from partner companies that assist in identity verification, background checks, or other relevant services.
We may also receive relevant data from companies whose products/services we offer on our Site or Platform.
(h) Unsolicited Information
If we receive unsolicited data (information you did not provide at our request), we will only keep, use, or disclose it in ways permitted by the Privacy Act. If not permitted, we will destroy or de-identify the data as appropriate.
Use of Personal Information
6.1 General use
We typically use the Personal Information collected to provide our Platform or Site to you, respond to your requests, and serve you better. Uses include (but are not limited to):
Creating, verifying, and securing your Account
Sending welcome emails and verifying email ownership
Identifying you as a User in our system
Prompting you to complete your profile after registration
Reviewing and approving Members (e.g., background checks)
Verifying credentials/identity
Administering and improving our Site, Platform, and related services (including accounting functions)
Providing requested assistance or services
Enhancing user experience and tailoring platform features to you
Delivering customer support (calls may be recorded for quality assurance)
Sending administrative notifications (security notices, policy updates, etc.)
Responding to inquiries, troubleshooting, or collecting feedback
Making telephone contact as needed for fraud prevention or feedback gathering
Sending newsletters, surveys, offers, and promotions related to Prema Care
Customizing advertisements on the Site or Platform
Facilitating collection or distribution of payments
Enforcing compliance with our Terms of Use and other policies
Addressing trust and safety concerns (complaints, misuse, disputes, etc.)
Monitoring or moderating content and communications for harmful or policy-violating usage
We may share Personal Information with third-party contractors to help us provide services, as described in section 7.3 (some of whom may be overseas, as described in section 7.4).
6.2 Creation of Anonymous Data
We may create anonymous data from Personal Information by removing details (such as your name) that could identify you. We use this anonymous data to analyze usage, improve our services, and for any other lawful purpose.
Disclosure of your Personal Information
7.1 We may share your Personal Information as explained below and elsewhere in this Policy.
7.2 External service providers and other third parties
We may share Personal Information with third-party vendors who help operate our Platform, verify background checks, monitor site usage, or process payments.
We may also disclose information to professional advisors (legal, administrative, financial, etc.).
If you have government funding, we may share your (or the relevant Client’s) Personal Information with funding providers or managers to verify eligibility.
We take steps to ensure our partners and advisors do not use your Personal Information for purposes other than those authorized by Prema Care.
7.3 Disclosure of Personal Information to overseas entities
We may transfer Personal Information to third parties located outside Australia (e.g., in the United States, the Philippines, India, etc.).
These third parties may be engaged in the functions described in section 6.1.
By providing Personal Information, you consent to its transfer to entities outside Australia.
We take reasonable measures to require overseas recipients to protect your data in accordance with Australian privacy law.
7.4 Direct Marketing
We may use your Personal Information to send you marketing or promotional materials.
You can opt out of direct marketing at any time using the unsubscribe feature or by contacting us.
Even if you opt out, we may still send you operational messages (e.g., policy updates).
7.5 Marketing on third-party sites
We may share Personal Information (e.g., email, phone) with operators of external sites or social media platforms so we can deliver tailored advertising.
7.6 Affiliates and acquisitions
We may share your Personal Information with our Affiliates, in which case they will either adhere to this Policy or have their own policy.
If another company acquires our shares, business, or assets, it may gain access to the Personal Information we hold, taking on the rights/obligations described in this Policy.
7.7 Other disclosures
Regardless of your choices, Prema Care may disclose Personal Information if we believe it is necessary to:
Support a legal investigation
Comply with laws, subpoenas, or warrants
Lessen or prevent a serious threat to life, health, or safety
Investigate or address suspected violations of law or policy
Respond to any permitted general or health-related situation under the Privacy Act
Cooperate with law enforcement
If you are a Client receiving care, you agree that a Support Worker may use the contact information of your emergency contact if needed.
Data collection
8.1 Information collected by ad networks
We may work with third-party advertising networks on our Site. These services may collect non-personally identifying data (but not your name, address, email, or phone) regarding your visits to this and other sites to provide tailored ads. This is typically done through cookies.
8.2 Information collected by other third parties
This Policy only applies to Prema Care’s handling of information. If you disclose data to others (including other Members), those parties are not bound by this Policy. We are not responsible for the privacy practices of third parties.
Your choices regarding your Personal Information
9.1 Choices about marketing
We may send you promotional communications. You can unsubscribe at any time (see 7.5).
Even if you opt out of marketing, we may still send operational or policy-related notices.
9.2 Deletion of Personal Information
You may request we delete your Personal Information, but we may retain it for legal reasons or other legitimate purposes.
If we determine we no longer need your data, we will take reasonable steps to destroy or de-identify it (unless otherwise required by law).
Even when deleted from active databases, your data may remain in archives for fraud prevention or as otherwise permitted by law.
If we’ve already disclosed some of your data to third parties, we cannot force them to delete it.
Security of your Personal Information
We use a variety of industry-standard security measures to guard your Personal Information.
Data is stored on secure servers in controlled facilities. We require you to use a password for your Account, and you should keep it confidential.
Notify us immediately if you suspect unauthorized use of your Account or a security breach.
While we make every effort to protect your data, no method of digital transmission or storage is 100% secure.
Our staff and contractors with system access are obligated to respect the confidentiality and privacy of your Personal Information.
Access to your Personal Information
You can request access to the Personal Information we hold about you by contacting us.
We generally permit access unless we’re required or entitled by law to refuse.
We aim to respond within a reasonable time and may charge a reasonable fee for processing requests.
If access is refused, we will typically provide our reasons unless legally prevented from doing so.
Correction of your Personal Information
We take steps to ensure your Personal Information is accurate, complete, and up to date.
If you believe your details are incorrect or outdated, please contact us or update your profile in your Account.
If we refuse to correct your data, we’ll let you know why. You may also submit a statement about the requested changes, and we will attach it to the relevant records where feasible.
Complaints
If you believe we have mishandled your Personal Information or violated the Australian Privacy Principles, please contact us at info@premacare.com.au. Provide as many details as possible.
Your complaint will be forwarded to our Privacy Officer for investigation, and we aim to respond within 30 days. We may request more info to ensure a thorough review.
